1 ACCEPTANCE OF TERMS
Your access to and use of http://www.little-chef.co.uk/ ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
3 CHANGES TO WEBSITE
Little Chef reserves the right to:
3.1 change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Little Chef shall not be liable to you for any such change or removal;
3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
4 LINKS TO THIRD PARTY WEBSITES
The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
5.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Little Chef or otherwise used by Little Chef as permitted by law.
5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
6 DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
6.2 To the extent permitted by law, Little Chef will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
6.3 Little Chef makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
6.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Little Chef for death or personal injury as a result of the negligence of Little Chef or that of its employees or agents.
You agree to indemnify and hold Little Chef and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Little Chef arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
9 GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
TREAT CUSTOMER REWARD SCHEME : TERMS AND CONDITIONS
To all Friends of Little Chef - Our Appreciation for your Loyalty
The Little Chef Friends reward card (TREAT Card) is our way of showing our appreciation for your loyalty by rewarding you when you visit one of our restaurants.
10.1 The definitions in this clause apply in the terms and conditions set out in this document:
10.1.0 Affiliates - Wycliffe Moore Limited (registered company number: 7152865) and Goldeneye Limited (registered company number: 6672040); in each case whose registered office address is at 31 Haverscroft Lane, Attleborough, Norfolk NR17 1YE and Affiliate shall be construed accordingly.
10.1.1 Customer Services - Little Chef’s customer services team available between the hours of 09:00 to 17:00 on Monday to Friday (excluding bank and public holidays) telephone number: 01953 450053, e-mail: firstname.lastname@example.org, address: 31 Haverscroft Industial Estate,New Road,Attleborough,Norfolk. 10.1.2 Little Chef - a trading name of (inter alia) Hybrid Dining Limited (registered company number: 7100679) whose registered office is at 31 Haverscroft Lane, Attleborough, Norfolk NR17 1YE.
10.1.3 Promotional Item - the item from our menu we determine at any point in time and from time to time (at our sole discretion) as being the item you must purchase to be eligible for a TREAT subject to these Terms.
10.1.4 Terms - the terms and conditions set out in this document as amended or updated from time to time.
10.1.5 TREAT(s) - any promotional giveaway(s) we determine at our sole discretion to award the holder of a TREAT Card.
10.1.6 we/us/our - Little Chef.
10.2 Headings do not affect the interpretation of these Terms.
11.1 Save as expressly provided otherwise, these Terms apply to the TREAT scheme and govern the relationship between us and you.
11.2 We may change these Terms at any time. To obtain the latest terms and conditions or for general enquiries please call Customer Services or visit our website at www.littlechef.co.uk
11.3 The TREAT scheme is operated by Little Chef. Subject to the Terms, anyone who collects a TREAT Card from one of our restaurants and registers their details can join.
11.4 All TREAT Cards are and remain the property of Little Chef.
11.5 Please read carefully - Use of your TREAT Card will constitute acceptance of the Terms. You should therefore read them carefully. Please print a copy of these Terms for your records. If there is anything you do not understand, please contact Customer Services.
11.6 The TREAT scheme is valid in all Little Chef restaurants.
11.7 Your TREAT Card is not a credit card, charge card, cheque guarantee or debit card.
11.8 Your TREAT Card is personal to you. You may not transfer your TREAT Card or any TREATs you are or may be entitled to under your TREAT Card to any other person. The TREAT Card has no cash or cash equivalent value.
12 OBTAINING YOUR TREAT CARD
12.1 You can obtain a Little Chef TREAT Card free of charge at any Little Chef restaurant.
12.2 A TREAT Card can only be registered in the name of an individual.
12.3 We do not issue additional TREAT Cards to individuals but your family and friends can of course apply for their own TREAT Card. Only one card may be registered in the name of any individual.
13 REGISTERING YOUR TREAT CARD
13.1 You will not be able to claim any TREATs with your TREAT Card until you have successfully registered your TREAT Card in accordance with condition 13.2. For the avoidance of doubt and without prejudice to any other provision within these Terms, you will not be entitled to claim any TREATs when you collect your TREAT Card.
13.2 You will need to register your TREAT Card online before you are eligible to participate in our rewards scheme and claim any TREATs. You can register and activate your TREAT Card by following the instructions on our website at http://www.littlechef.co.uk/friends/register
14.1 We might change at any time and on any number of occasions the Promotional Items and the number and type of TREAT you may claim under the TREAT scheme.
14.2 Details of the relevant Promotional Item and the corresponding TREAT will be notified by Little Chef.
14.3 Subject to these Terms, TREATs shall be restricted to any item we may notify as being included in the scheme and must be of a retail price equivalent to or lower than the retail price of the relevant Promotional Item purchased.
15 USING YOUR TREATs CARD AND COLLECTING YOUR TREATs
15.1 TREAT Cards must be presented when paying your bill so that the bar code on the card can be swiped.
15.2 Subject to these Terms, you will receive a TREAT when you purchase the relevant Promotional Item.
15.3 Without prejudice to condition 15.4, you may only claim one TREAT per Promotional Item purchased unless otherwise notified by us.
15.4 Where TREATs are advertised on a multiple basis, you may only claim one TREAT at a time from our tillpoints.
15.5 TREATs must be claimed on the day of purchase of the relevant Promotional Item. TREATs cannot be claimed at a later date.
15.6 No TREAT will be awarded if you do not present your TREAT Card in accordance with these Terms.
15.7 We may at any time modify, substitute or remove Promotional Items available for TREATs.
15.8 You will not be entitled to claim TREATs on any TREAT claimed under the TREAT scheme. TREATs will only be awarded against a purchase of the relevant Promotional Item unless we notify otherwise.
16 RETURNING ITEMS
If we agree for you to return a Promotional Item purchased or otherwise offer any refund on any Promotional Item, you will no longer be entitled to claim any corresponding TREATs on such items.
17 UPDATING YOUR DETAILS
If you need to change any of the details you have registered for your TREAT Card, please log onto the Little Chef web site www.littlechef.co.uk/friends/fancyachange and log into your account. It is your responsibility to notify us of any changes to your details.
18 EXPIRY AND CANCELLATION
18.1 Your Little Chef TREAT Card does not have an expiry date. However Little Chef may cancel or withdraw the TREAT scheme or any individual TREAT Card at any time.
18.2 Little Chef may refuse or revoke any membership of the TREAT scheme at any time without the need to give any reason.
18.3 Little Chef may take any action it considers appropriate if it has reason to believe that you are abusing the TREAT scheme.
19 LOSS, THEFT AND DAMAGE
19.1 If you lose or mislay your TREAT Card or if it is stolen, damaged or malfunctions, you must notify Customer Services so that we can cancel your existing TREAT Card. You can transfer your account information to a new TREAT Card account provided you pick up a new TREAT Card from any Little Chef restaurant, register it within 7 days of cancelling your existing TREAT Card and enter your e-mail address and login details to your old account to transfer your account information.
19.2 It is your responsibility to keep your TREAT Card safe. Little Chef accepts no responsibility or liability for any loss or unauthorised use of any TREAT Card.
20 DATA PROTECTION AND PRIVACY
20.1 As part of the registration process, you will be required to provide certain personal information, including your name, address, mobile telephone number and contact details. You will be ineligible to participate in the TREAT scheme if you fail (for whatever reason) to provide such information.
20.2 Hybrid Dining Limited and its group companies and its affiliates; each trading as Little Chef (a list of which is at 10.1.2) will use your personal data by which we mean information we obtain directly from you, or information we obtain as a result of our relationship with you, such as your name, address, mobile telephone number, contact details and spending habits, for the purpose of marketing, customer services, customer profiling, analysing your purchasing preferences, improving our products, informing you of any offers, products and promotions we are running or propose to run and any other purpose which we determine may be advantageous to you or Little Chef.
20.3 You have a right to request a copy of the personal data we hold about you, (for which we may charge a small fee) and (without prejudice to condition 15) to correct any inaccuracies in your information.
20.4 We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act 1998 and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.
20.5 Except as required by law, or in accordance with these Terms, your personal information will not be passed to any other persons without your permission.
21 LIABILITY OF LITTLE CHEF - EVENTS OUTSIDE OUR CONTROL
21.1 We will not be liable or responsible for any failure to perform, or delay in performing any of our obligations under these Terms that is caused (directly or indirectly) by events outside our reasonable control (“Force Majeure Event”)
21.2 A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes, in particular (without limitation), the following:
21.2.1 strikes, lock-outs or other industrial action;
21.2.2 civil commotion, riot, invasion, terrorist attack or threat, war (whether declared or not) or threat or preparation for war;
21.2.3 fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
21.2.4 impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
21.2.5 impossibility of the use of public or private telecommunications networks;
21.2.6 the acts, decrees, legislation, regulations or restrictions of any government;
21.2.7 pandemic or epidemic.
21.3 Our obligations under these Terms are suspended for the period that the Force Majeure Event continues, and we will have an extension of time to perform these obligations for the duration of that period.
22 CUSTOMER CARE
22.1 If you need assistance or if you have any enquiry relating to your TREAT Card, you can use the Contact Us facility on the Little Chef website or you can contact Customer Services.
22.2 Complaints regarding any element of the Little Chef TREAT Card service should be sent in writing or by email to Customer Services or by contacting us via our website: www.littlechef.co.uk/feedback
22.3 All complaints will be subject to the Little Chef complaints procedure details of which will be provided to you on request to Customer Services.
We can transfer all or any of our rights and obligations under these Terms to another entity or organisation, but this will not affect your rights under these Terms.
24.1 If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
24.2 If we fail, at any time while these Terms are in force, to insist that you perform any of your obligations under these Terms, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. If we do waive a default by you, that will not mean that we will automatically waive any subsequent default by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
24.3 A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
24.4 These Terms shall be governed by English law and we both agree to the non-exclusive jurisdiction of the English courts.
